The Delhi High Court recently passed an order protecting the personality and image rights of Bollywood star Jackie Shroff and banned entities from unauthorized apply of the ‘Bhidu’ actor’s name, voice, photos and signature. According to Bar and Bench, an interim order was issued on May 15, whereby Justice Sanjeev Narula ordered the removal of several links that were pornographic in nature and contained the actor’s name.
However, Justice Narula refused to grant an interim injunction against the person running the YouTube channel posting the allegedly offensive compilations of Shroff’s interviews under the Live Law.
“…The Court considers it crucial to balance the legitimate interests of Defendant No. 5 in artistic and economic expression with the Plaintiff’s rights to personality, publicity and moral integrity. Accordingly, the court would like to obtain a response from respondent No. 5 before expressing its position on the matter,” Live Law reported, quoting the court. Actor Teri Meherbaniyan asked the Court to protect his voice, image, likeness and all other elements of his personality.
This is not the first time a Bollywood actor has sought assist from the court regarding privacy and publicity rights. Before Jackie, few other Bollywood stars had their personal rights legally protected.
In 2022, the Delhi High Court issued an interim order prohibiting persons from violating the personal rights and image rights of legendary actor Amitabh Bachchan.
In addition to Jackie and Substantial B., Anil Kapoor also approached the Delhi High Court last year to protect his personal rights. Earlier this year, in January, Anil won a case protecting against unauthorized apply of the slogan ‘Jhakaas’, his name, voice, manner of speaking, image, likeness and gestures.
